The ownership is held by the bare owner, who is the person who owns the property.<\/p>\n<p><\/p>\n<p><b>What types of usufruct are there?<\/b><\/p>\n<ul>\n<li><b>Simple:<\/b> only one person lives there.<\/li>\n<li><b>Multiple:<\/b> different people enjoy, at the same time or successively, the dwelling.<\/li>\n<li><b>Own:<\/b> related to real estate.<\/li>\n<li><b>Improper:<\/b> related to consumable goods.<\/li>\n<li><b>Partial:<\/b> affects a part of the property.<\/li>\n<li><b>Total: <\/b>affects the entire property.<\/li>\n<li><b>Legal: <\/b>that which the law imposes (ex: assets of the deceased).<\/li>\n<li><b>Voluntary:<\/b> bilateral contract or last will (will).<\/li>\n<\/ul>\n<p><\/p>\n<p><b>What is a usufructuary?<\/b><\/p>\n<p>A <b>usufructuary<\/b> is a person who has possession of a property, but not ownership. It is the holder of the usufruct. As he\/she is not the owner, he\/she cannot sell or give it away without consent.<\/p>\n<p><\/p>\n<p><b>Rights of the usufructuary:<\/b><\/p>\n<ul>\n<li>Right to dispose of the usufruct.<\/li>\n<li>Right to improve the property.<\/li>\n<\/ul>\n<p><\/p>\n<p><b>Obligations of the usufructuary:<\/b><\/p>\n<ul>\n<li>To preserve the home.<\/li>\n<li>To make an inventory before moving into the home.<\/li>\n<li>To pay a deposit as a guarantee that he\/she will comply with the obligations.<\/li>\n<li>To return the home when the usufruct ends.<\/li>\n<\/ul>\n<p><\/p>\n<p><b>What is the bare ownership?<\/b><\/p>\n<p>The <b>bare ownership<\/b> is the right of a person to a property of which he\/she is the sole owner. He or she has dominion over the property, but does not have possession because there is a usufruct, i.e. he or she cannot live in the property for the time being.<\/p>\n<p><\/p>\n<p><b>What is a bare owner?<\/b><\/p>\n<p>The <b>bare owner<\/b> is the person who has the ownership of the house. It is limited because there is a usufructuary. The bare owner will become the full owner when the usufruct is extinguished.<\/p>\n<p><\/p>\n<p><b>How can the usufruct be extinguished?<\/b><\/p>\n<ul>\n<li>Death of the usufructuary.<\/li>\n<li>Expiration of the term (if there is a contract).<\/li>\n<li>Consolidation of the usufruct and ownership in the same holder.<\/li>\n<li>Renunciation of the usufructuary.<\/li>\n<li>Loss or extinction of the dwelling.<\/li>\n<li>Termination of the constituent&#8217;s right.<\/li>\n<li>Prescription for not using the property for the period of time established by law.<\/li>\n<\/ul>\n<p><\/p>\n<p><b>What are the rights of the bare owner?<\/b><\/p>\n<ul>\n<li>The right to recover the house in good condition when the usufruct is extinguished.<\/li>\n<li>By maintaining the usufruct, he can sell his bare property.<\/li>\n<\/ul>\n<p><\/p>\n<p>If the usufructuary is a town, Corporation or Society, the duration of the usufruct will be a maximum of 30 years.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>What is usufruct?
