Tot i aix\u00f2, no sempre queda clar qu\u00e8 implica assumir aquest paper ni quins s\u00f3n exactament els <strong>drets i obligacions de l\u2019aval.<\/strong> Si t\u2019han demanat que siguis avalador o t\u2019est\u00e0s plantejant aquesta possibilitat, \u00e9s clau que tinguis tota la informaci\u00f3 abans de prendre una decisi\u00f3.<\/p>\n\n\n\n<p>En aquest post t\u2019expliquem, de manera clara i sense tecnicismes innecessaris, qu\u00e8 significa ser avalador, quines responsabilitats assumeixes i quins drets et protegeixen.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Qu\u00e8 \u00e9s un avalador i quin paper t\u00e9?<\/h2>\n\n\n\n<p>Abans d\u2019entrar en mat\u00e8ria, conv\u00e9 aclarir <strong>qu\u00e8 \u00e9s un avalador<\/strong>. Un avalador \u00e9s la persona que respon davant d\u2019un deute ali\u00e8 si el titular principal no compleix amb les seves obligacions de pagament. En l\u2019\u00e0mbit immobiliari, aix\u00f2 \u00e9s especialment habitual en hipoteques, quan el banc exigeix una garantia addicional.<\/p>\n\n\n\n<p>L\u2019avalador no \u00e9s el propietari de l\u2019habitatge ni el titular del pr\u00e9stec, per\u00f2 assumeix un comprom\u00eds legal molt rellevant. En cas d\u2019impagament, l\u2019entitat financera pot reclamar directament a l\u2019avalador, fins i tot abans d\u2019exhaurir les vies contra el deutor principal, si aix\u00ed s\u2019ha pactat al contracte.<\/p>\n\n\n\n<p><\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Principals obligacions de l\u2019aval<\/h2>\n\n\n\n<p>Parlar dels drets i obligacions de l&#8217;aval implica comen\u00e7ar per la part menys amable: les responsabilitats. Ser avalador no \u00e9s un simple tr\u00e0mit, sin\u00f3 un comprom\u00eds que pot tenir conseq\u00fc\u00e8ncies patrimonials importants.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Respondre del deute en cas d\u2019impagament<\/h3>\n\n\n\n<p>La principal obligaci\u00f3 de l\u2019avalador \u00e9s fer front al deute si el titular no paga. No es pot retirar unilateralment, encara que la situaci\u00f3 econ\u00f2mica de l\u2019avalador canvi\u00ef.<\/p>\n\n\n\n<p><\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Drets de l\u2019avalador que has de con\u00e8ixer<\/h2>\n\n\n\n<p>Tot i les obligacions, l\u2019avalador tamb\u00e9 t\u00e9 drets que sovint es desconeixen i que poden marcar una gran difer\u00e8ncia.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Dret a la informaci\u00f3<\/h3>\n\n\n\n<p>L\u2019avalador t\u00e9 dret a con\u00e8ixer totes les condicions del pr\u00e9stec que avala. Aix\u00f2 inclou imports, terminis, tipus d\u2019inter\u00e8s i possibles modificacions contractuals.
