No obstant aix\u00f2, des d&#8217;una an\u00e0lisi estrictament immobili\u00e0ria, aquesta nova normativa planteja dubtes rellevants sobre la seva efic\u00e0cia real i, sobretot, sobre les conseq\u00fc\u00e8ncies que pot tenir en l&#8217;oferta disponible. <\/p>\n\n<p>Un dels principals objectius de la llei \u00e9s evitar que el lloguer de temporada s&#8217;utilitzi com a via per sortejar els topalls de preu establerts a les zones tensionades. No obstant aix\u00f2, <strong>equiparar aquest tipus de contractes al lloguer habitual, sense distingir adequadament les seves funcions i perfils de demanda, pot acabar generant l&#8217;efecte contrari al desitjat:<\/strong> una retirada progressiva d&#8217;habitatges del mercat del lloguer <\/p>\n\n<p>Molts propietaris que fins ara optaven pel lloguer de temporada \u2014dirigit a professionals despla\u00e7ats, estudiants internacionals o fam\u00edlies en situacions transit\u00f2ries\u2014 poden percebre aquesta regulaci\u00f3 com a p\u00e8rdua de flexibilitat i seguretat jur\u00eddica. En aquest context, <strong>la decisi\u00f3 de no llogar, de vendre l&#8217;immoble o de destinar-lo a altres usos \u00e9s cada cop m\u00e9s habitual, reduint encara m\u00e9s una oferta ja clarament insuficient.<\/strong> <\/p>\n\n<p>Pel que fa al lloguer d&#8217;habitacions, la limitaci\u00f3 del preu total de l&#8217;habitatge pot dificultar models que, ben gestionats, havien contribu\u00eft a ampliar opcions residencials en entorns urbans amb una demanda molt elevada. <strong>La regulaci\u00f3 del preu, sense mesures que incentivin la incorporaci\u00f3 de nous habitatges al mercat, tendeix a actuar nom\u00e9s sobre els efectes, per\u00f2 no sobre les causes del problema.<\/strong><\/p>\n\n<p>El repte de l&#8217;acc\u00e9s a l&#8217;habitatge \u00e9s profund i estructural. Requereix pol\u00edtiques a mitj\u00e0 i llarg termini orientades a <g id=\"gid_0\">incrementar l&#8217;oferta<\/g>, facilitar la promoci\u00f3 d&#8217;habitatge -tamb\u00e9 de lloguer-, reduir traves administratives i generar confian\u00e7a tant en propietaris com en inversors. Sense aquests elements qualsevol regulaci\u00f3 de preus corre el risc de ser una soluci\u00f3 incompleta.  <\/p>\n\n<p>Des d&#8217;Espigul Real Estate Group considerem imprescindible un debat obert, rigor\u00f3s i allunyat de plantejaments simplistes. El mercat immobiliari necessita estabilitat, seguretat jur\u00eddica i una visi\u00f3 global que permeti garantir l&#8217;acc\u00e9s a l&#8217;habitatge sense comprometre la viabilitat del propi mercat.
